TUPCA = Texas Uniformed Planned Community Act....we have been
able to get across to the legislators that this is not a good bill
for homeowners; however, we must be diligent next session in looking
for clone bills that will appear in other bills under different
names, but same substance. We must stop homeowner association
abuse which includes ALL homeowner association foreclosures.
Any foreclosure can be used against a minority, a handicap, a
senior citizen, against any vulnerable homeowner.
Foreclosures disguised as a protection of property rights and a way
to punish those who do not pay to protect those who do is not the
real, underlying reason for homeowner associations' determination to
hold onto the foreclosure hammer.
The continuation to protect the foreclosure hammer over the
protection of our Constitution is fueled by greed from those
benefiting from foreclosures such as Community Association Institute
(CAI) attorneys, management companies owed by business people and
some legislators such as Senator John Carona and other commercial,
municipalities and development planners who see property and
homeowners as a grand plan to power, wealth, amenity responsibility
transfer from city government to mini homeowner association
governments, population control and racial neighborhood
cleansing.
